Rules of "Fight COVID-19 Open Challenge”


Before reading the Rules of this Challenge, we kindly advise you to check our General User Terms & Conditions and Privacy Policy of the TAIKAI Platform.


1. Organization of the challenge


TAIKAI, Lda., a company registered with the Portuguese Companies Registry under no. 515012718, having its registered office at Rua Álvaro Ferreira Alves, 29 rc dt, 4100-038 Porto and with a share capital of € 575,00 (hereinafter referred to as the “TAIKAI”), with the organization of a Challenge as set out below; the Challenge shall take place from 14 of March 2020, with no end date at the moment, via the website available here (hereinafter referred to as the “Challenge”). TAIKAI shall be considered as the organizer of the Challenge (hereinafter referred to as the “Organizer”).


2. Definitions


In this document,


“Overview”: refers to the specifications determined by the Organizer, which may include the deadlines, the prizes, the guidelines and themes to be complied with by all Innovators contributions.


“Challenge”: refers to the challenge that is the subject of the Rules, as organized by the Organizer.


“Intellectual Property Rights” means all the following ownership legal rights, worldwide, whether registrable or unregistrable, and whether registered or unregistered, with respect to any designs, trade secrets, copyrights, works of authorship, neighbouring rights, mask works, Know-how, Software and all the industrial rights, such as trademarks, industrial designs or patents;


“Open Source” refers to the permission to use the source code, design documents, or content of the product.


“General User Terms & Conditions and Privacy Policy”: designate the general terms of use of the TAIKAI’s website and its Privacy Policy, accepted by every Innovator during the creation of a TAIKAI user account and readable on taikai.network


“Projects”: refers to the Team and to all submissions, original ideas, documents or other materials (such as presentations, videos, code, websites, etc.) uploaded to the Website by Innovators in response and as a solution to this Challenge;


“Innovator”: refers to any person registered in accordance with the Rules who takes part in the Challenge.


“Registration”: refers to the registration of an Innovator in accordance with the Rules.


“Rules”: refers to these terms, which apply to the Challenge.


“Team”: refers to the team of innovators, created on the platform in order to take part in the Challenge.


3. Purpose of the rules


3.1. Rules are intended to define the terms and rules of participation in the Challenge organized by TAIKAI. Rules are destined to complete the General User Terms & Conditions and the Privacy Policy of the TAIKAI Platform, which can be downloaded through the links provided previously. In the event of inconsistency between these rules and regulations and those of the Terms & Conditions and Privacy Policy, these Rules will prevail.


3.2. The Innovator should be aware and agrees to the fact that the proposed Challenge calls on his/her wisdom, skill, and cleverness during extremely difficult trials. The Challenge shall not depend, even partially, on chance and luck under any circumstances, and can therefore not be considered as, or resemble a lottery.


4. Conditions for entering the challenge


4.1. Participation in this Challenge is free


4.2. The Innovator must read these Rules, and fully accept their terms in their entirety without reservation before its Registration and participation in the Challenge.


4.3. Participation in the Challenge is under the conditions of: being any person on legal age every document or information published on the platform should be open source


4.4. The Innovator guarantees that he/she will abide by the rules mentioned above. The delivery of the Prize will be conditional upon the capacity of the Innovator to meet the conditions stated.


4.5. There is only one entry per person in the Challenge


4.6. Innovators have no restrictions on the number of team members to form teams.


5. Registration and access to the challenge


5.1. For his/her Registration to the Challenge, each Innovator must open a user account on taikai.network and must indicate the following:

  • A valid username
  • A valid email address
  • A valid password To validate his Registration, the Innovator must accept the General Terms & Conditions and Privacy Policy provided by TAIKAI.

To complete his/her Registration in the Challenge, the Innovator must opt-in on the box indicating that he/she accepts the Challenge Regulations. A confirmation email containing a confirming link is sent to the Innovator’s listed email address. Once his/her account is confirmed, the Innovator can freely participate and complete their profiles.


5.2. Any Registration containing wrong, dubious, or incomplete information shall not be taken into account and disqualifies the Innovator and/or the Innovator’s Team from the Challenge.


5.3. By registering, the Innovator accepts being contacted through email by the Organizer, for the duration of his/her participation in the Challenge.


6. Duration of the challenge


6.1. The Challenge shall take place from the 14th of March and currently as no date to end.

  • The Challenge will be revealed and registration will begin on the 14th of March
  • Registration for participation will be always open until the end of the challenge
  • Project submission will take place from the 14th of March and currently as no date to end.

6.2. Every date clearly defined in these Rules and the Challenge is in the Lisbon time zone (GMT), and refers to the year 2020.


6.3. Where necessary, due to operational requirements, the Organizer reserves the right to alter the duration of the Challenge by a reasonable amount of time, which will be conveyed to Innovators.


7. Principle of the challenge


7.1. The Challenge consists of making contributions formed by deliverables which are in accordance with the requirements listed in point 8 and 9.


7.2. The deliverable must absolutely respond to the Challenge definition and rules described in this document. The deliverable must be written in English so that it may contribute to everybody in the entire world; no other language will be accepted. The Organizer will not accept nor review any other documents submitted by the Innovators.


8. Deliverables


8.1. The Project Deliverables must absolutely respond to the Challenge definition and rules described in the tab “Rules” on the Challenge page.


8.2. From the 14th of March, the Innovators will have to publish on the platform, their Project Description, comprised of:

  • COVID-19 issue addressed
  • A description that includes a brief explanation of what the solution is and what problem is it tackling.
  • Screenshots or pictures from the Application
  • Source Code link
  • Technology Stack used
  • User Target Profile (Age, Gender, Profession,etc.)

8.3. Besides Project Description, participants should attach to the Project:

  • Slide Presentation about the project
  • Screenshots, Image, Diagrams and Videos

8.4. All the attachments, video, and resources with more than 10Mb might be uploaded to external websites like (Dropbox, Google Drive, etc.) and provided as links in the project description.


8.5. Innovators guarantee that the content of the Project consists only of their Team’s contributions and none others. If there are suspicions that contributions are from a third party, all Innovators from that Team may be disqualified.


9. Selection process


9.1. The purpose of this challenge is not to find winners or select the best solutions. It is to unite people and bring them together into building the highest number of solutions possible to prevent and fight COVID-19. Considering this, we’ve decided to cancel the selection process for now.


10. Image copyright


The use of photos or images must be free from copyright. In any case, the Organizer will not be held responsible for the use of Intellectual Property for which third parties have rights.


11. Prizes


11.1. We’re experiencing a worldwide crisis and we need to act fast. As such, having Prizes for participation is not our main concern at the moment, as we want to speed up the number of solutions to stop the virus from spreading.


11.2. However, we promise to do our best to find a way to reward you for your hard work and for being able to take a step further as a hero to present and future generations.


12. Intellectual property


12.1. Definition "Intellectual property rights" refers to any Invention, any copyright or other rights over a brand or model and, more generally, any element that may be protected by international laws or conventions on intellectual property.


12.2. Any Project involving several Innovators constitutes a collaborative work.


12.3. As such, the Organizer is free to reproduce the Projects, to distribute them, to inform the public about them and to modify them. If the Projects are modified, altered or adapted, the Organizer may distribute the resulting derived work only in accordance with the terms agreed on these Rules.


12.4. Each Innovator guarantees that he/she is the co-owner and co-holder of the Intellectual Property Rights regarding all or part of the deliverables submitted as part of the Challenge for the Project of which he/she is a member and that he/she has obtained all rights and permissions regarding all pre-existing elements and any elements for which he/she does not hold the rights if these elements are to be included in the deliverables of all voting phases. Each member of a Participating Team guarantees that his/her application is original and unprecedented, that it does not infringe upon the copyright of any third party, and that all the elements of which it is formed, as well as all pieces of information communicated in the application presentation document, are accurate, reliable and complete. It is compulsory for Innovators to indicate the source of any pre-existing elements (music, text, images, etc.) that are included in the deliverables. Each Innovator ensures good use of the deliverables provided by the Organizer, and as such ensures:

  • that the deliverables submitted by the Team of which he/she is a member is original,
  • that it does not infringe on or imitate any copyright, patent, brand or any other intellectual property belonging to a third party,
  • that it does not constitute an act of unfair competition or parasitical competition of any kind,
  • that all the elements of which it is formed, as well as all pieces of information communicated in the deliverables, are accurate, reliable and complete.
    Each Innovator indemnifies the Organizer and any present and future subsidiaries against any disturbance, action, claim, opposition, demand or eviction attempt from any third party.

12.5. During and after the end of the Challenge, the Innovators have the right to use and register the Intellectual Property resulted from the Projects created (e.g. code, algorithms, etc.) for their own personal use, as long as it remains open-sourced and free for everyone to use, and visible on the TAIKAI platform.


13. Communication


13.1. Every Innovator authorizes the Organizer, in the case where he/she would be appointed an Eligible Team of the Challenge to use his/her last name, his/her first name, his/her twitter address, his/her city and region of residence, the name of his/her University/Startup or former University and his/her photograph, name in any promotional demonstration (except with the purchase of advertising space), including on the web sites of TAIKAI and any site or affiliated support, without that this use can legally give rise to any remuneration for 2 years maximum after the end of the Challenge.


14. Liability


14.1. The responsibility of the Organizer cannot be engaged in case of breakdown or dysfunction of the used telecommunications network, whatever the cause is, which would have the effect of damaging or preventing the identification or the access of the Innovator on taikai.network or any other useful web site for the participation in the Challenge.


14.2. The participation in the Challenge implies knowledge and acceptance of the characteristics, limitations and risks of the internet network and the technologies which are linked to it, particularly in consideration of the performances, in response time, in the security of the software and the computer hardware towards diverse potential attacks such as viruses, logic bomb or Trojan horses and in the loss or diversion of data. Therefore, the Organizer cannot be held responsible for the damages caused to the Innovator because of these accepted characteristics, limitations and risks.


14.3. The Organizer cannot, in any case, be held responsible for any damage caused by the defect or the delay of the delivery of the Projects, in particular for the refusal to consider late submissions, or for any damage caused by the impossibility to connect to the relevant websites or to upload/download correctly any delivery, the defect or the delivery time of any email sent during the Challenge, or for any damage caused by any hurdle preventing the Innovator attending or participating in the whole or part of the Challenge.


14.4. The Organizer cannot be held responsible in case of total or partial modification, suspension, interruption, adjournment or cancellation of the whole or part of the Challenge for reasons beyond their control. In such a case, the Organizer will inform the Innovators as soon as possible via the taikai.network or by any means it sees fit.


14.5. The Organizer cannot be held responsible for the consequences of disqualification of an Innovator, and/or a Team, due to a violation of the Rules, and/or in case of rejection of a Project due to noncompliance with the Rules.


14.6. The Organizer shall not be liable for any trouble, action, claim, objection, claim related to the use of the Projects of the Organizer not foreseen by the Rules or in connection with the negotiation, execution or performance of contracts that the Organizer would sign with the Innovators.


14.7. In any case, the Organizer will not be held responsible for the delivery of the Prizes nor in case of impossibility for a Winner to benefit from his/her Prize for circumstances beyond the Organizer’s control. The responsibility of the Organizer cannot be engaged in case of loss and/or deterioration of the Prize by post or any third similar service provider and more generally if the Winner does not receive his/her Prize. The responsibility of the Organizer cannot be engaged in case of incidents or of damages of all kinds, which could arise because of the enjoyment of the awarded Prize and/or because of its use.


15. Confidential information


15.1. “Confidential Information” is defined in this present Rules, is all the material or immaterial information of whatever nature, in particular administrative, commercial, scientific, technical, financial, fiscal, which was, is or will be communicated by the Organizer to the Innovator, directly or indirectly, and in a non-exhaustive way, orally, in writing, by delivery of paper or electronic documents. Information that is not confidential is:

  • The currently accessible information or becoming accessible to the public without breach of the Rules from the Innovator,
  • The information legally held by the Innovator before their disclosure by the Organizer,
  • The information not resulting either directly or indirectly from the use of all or part of the Confidential Information,
  • The information validly obtained close to a third party authorized to transfer or to reveal the information mentioned above.

15.2. For the duration of the Challenge and during a period of five (5) years after the end of the Challenge stated on section 6, the Innovator, under penalty of civil and / or criminal liability, commits to:

  • Not using the Confidential Information for any other purposes than the participation in the Challenge in the conditions of the Regulations;
  • Taking any necessary, useful and reasonable precaution to protect the Confidential Information;
  • Not Revealing the Confidential Information to whomever, by any means whatsoever, except to the other members of his/her Team;

15.3. At the end of the Challenge, because of the emergence of their term indicated to Point 6 or of their cancellation, the Innovator will immediately have to put back to the Organizer all the Confidential Information, whatever their support is, obtained during the Challenge, under penalty of civil and / or criminal liability. The Innovator forbids himself from keeping a copy in any form whatsoever, except with an on purpose, preliminary and written agreement by the Organizer.


16. Rules


16.1. The participation in the Challenge and the awarding of the Prize requires the acceptance purely and simply and the full respect for the Rules in all its terms. The Organizer reserves the right to disqualify, immediately and without compensation, every Innovator and/or Project not satisfying in full with the Rules.


16.2. The Organizer reserves the right to modify at any time the terms of the Rules, and during the Challenge without the requirement of notification to the Innovator, concerning the application and the validity of these modifications. The Innovator is invited to consult regularly the Rules. The Innovator gives up expressly any complaint or contesting linked to any modification brought to the Rules by the Organizer.


17. Cancellation and suspension of the challenge


17.1. The Organizer reserves the right to cancel, shorten, suspend the Challenge without prior notice:

  • In cases of greater force;
  • If it appears that fraud has occurred in any form whatsoever;

17.2. The Organizer cannot be held responsible for cancellation or suspension of the Challenge according to the present Point and no allowance nor compensation will be due to the Innovator.


18. Independence


18.1. The Registration and participation in the Challenge are not, in any way, for effect to create a link of subordination between the Organizer and the Innovator.


19. Claims


19.1. Any claim of the Innovator must be sent in writing during the last 30 days after the ending date of the Challenge.


19.2. Claims linked to the functioning of the website taikai.network must be formulated in writing at the following address: TAIKAI, Lda. Building Connections, Av. Serpa Pinto 311, 4450-718 Matosinhos, Portugal


19.3. Claims linked to the progress of the Challenge and to the sending of the Prize must be formulated in writing at the following address: TAIKAI, Lda. Building Connections, Av. Serpa Pinto 311, 4450-718 Matosinhos, Portugal


19.4. At the risk of being rejected, any claim has to contain: Full contact details of the Innovator (name, first name, address, zip code, city, taikai login and e-mail); The identification of the concerned Challenge; The clear and elaborate presentation of the motives for the claim.


20. Preliminary reconciliation


20.1. In case of a persistent dispute after the Innovator has made a complaint in accordance with Point 19, the Organizer and Innovators agree to submit their dispute to an amicable settlement before any court proceedings.


20.2. The party eager to initiate conciliation must inform the other party through a registered letter with acknowledgement of receipt in which it will make him know his intentions and it will specify the cause.


20.3. If no agreement is reached between the parties within 30 days of the registered letter reception, parties regain their freedom of action.


21. Applicable law


The Regulations and the Challenge are under Portuguese law. You accept that any litigation related to the Challenge will be submitted exclusively to the Courts of Porto.

Antes de ler as Regras deste Desafio, recomendamos que consulte os nossos Termos & Condições Gerais de Utilizadoção e a Política de Privacidade da Plataforma TAIKAI.


1. Organização do desafio


TAIKAI, Lda., uma empresa registada com o Número de Identificação de Pessoa Coletiva 515012718, com sede na Rua Álvaro Ferreira Alves, 29 rc dt, 4100-038 Porto e um capital social de € 575,00 (doravante “TAIKAI”), com a organização do Desafio conforme descrito de seguida; o desafio terá início a 14 de Março de 2020, sem data de término até ao momento, através do website disponível aqui (doravante “Desafio”). TAIKAI será considerada a organizadora do Desafio (doravante “Organizadora”).


2. Definições


Neste documento,


“Visão Geral”: refere-se às especificações determinadas pelo Organizador, que podem incluir os prazos, os prémios, as diretrizes e os temas a serem cumpridos por todas as contribuições dos Inovadores.


“Desafio”: refere-se ao desafio que é objeto das Regras, conforme organizado pelo Organizador.


“Direitos de Propriedade Intelectual” significa todos os seguintes direitos legais de propriedade, em todo o mundo, registáveis ou não, e registados ou não, com relação a quaisquer designs, segredos comerciais, direitos de autor, obras de autor, direitos vizinhos, trabalhos de máscara, Know-how, Software e todos os direitos industriais, como marcas comerciais, desenhos industriais ou patentes;


"Código Aberto" refere-se à permissão para usar o código fonte, documentos de design, ou o conteúdo do produto.


“Termos & Condições Gerais do Utilizador e Política de Privacidade”: designam os termos gerais de uso do site da TAIKAI e a sua Política de Privacidade, aceites por todos os Inovadores durante a criação de uma conta de utilizador da TAIKAI, e disponíveis em taikai.network


“Projetos”: refere-se à Equipa e a todos as inscrições, ideias originais, documentos ou outros materiais (como apresentações, vídeos, código, websites, etc.) enviados para o Website por Inovadores em resposta e como solução para este Desafio;


“Inovador”: refere-se a qualquer pessoa registada de acordo com as Regras, que participe no Desafio. "Registo": refere-se ao registo de um Inovador de acordo com as Regras.


"Regras": refere-se aos termos que se aplicam ao Desafio.


“Equipa”: refere-se à equipa de inovadores, criada na plataforma para participar no Desafio.


3. Objetivo das regras


3.1. As regras têm como objetivo definir os termos e regras de participação no Desafio organizado pela TAIKAI. As regras destinam-se a completar os Termos & Condições Gerais de Utilização e a Política de Privacidade da Plataforma TAIKAI, as quais podem ser descarregadas através dos links fornecidos anteriormente. No caso de inconsistência entre estas regras e regulamentos e os Termos e Condições e a Política de Privacidade, estas regras prevalecerão.


3.2. O Inovador deve estar ciente e concordar com o facto de que o Desafio proposto exige a sua sabedoria, habilidade e inteligência, durante provações extremamente difíceis. O Desafio não dependerá, mesmo que parcialmente, do acaso e da sorte sob nenhuma circunstância e, portanto, não poderá ser considerado como, nem se parecer com, uma lotaria.


4. Condições para entrar no desafio


4.1. A participação neste desafio é gratuita


4.2. O Inovador deve ler estas Regras e aceitar os seus termos na íntegra, sem reserva, antes do seu Registo e participação no Desafio.


4.3. A participação no Desafio tem a condição de: ser maior de idade, e todos os documentos ou informações publicadas na plataforma devem ser de código aberto


4.4. O Inovador garante que cumprirá as regras mencionadas acima. A entrega do Prémio dependerá da capacidade do Inovador de cumprir as condições estabelecidas.


4.5. É apenas aceite uma inscrição por pessoa no Desafio


4.6. Os inovadores não têm restrições quanto ao número de membros de equipa para formar equipas.


5. Inscrição e acesso ao desafio


5.1. Para o seu registo no desafio, cada inovador deve abrir uma conta de utilizador na taikai.network e deve indicar o seguinte:

  • Um nome de utilizador válido
  • Um endereço de email válido
  • Uma senha válida para validar o seu Registo. O Inovador deve aceitar os Termos & Condições Gerais e a Política de Privacidade fornecidos pela TAIKAI.

Para concluir o seu Registro no Desafio, o Inovador deve ativar a caixa indicando que aceita os Regulamentos do Desafio. Será enviado um email de confirmação para o endereço de email do Inovador, contendo um link de confirmação. Depois da sua conta ser confirmada, o Inovador poderá participar e completar o seu perfil livremente.


5.2. Qualquer registo contendo informações erradas, duvidosas ou incompletas, não será tido em consideração e desqualifica o inovador e/ou a equipa do inovador do desafio.


5.3. Ao fazer o registo, o Inovador aceita ser contactado por e-mail pelo Organizador, enquanto durar a sua participação no Desafio.


6. Duração do desafio


6.1. O Desafio ocorrerá a partir de 14 de março e, atualmente, não tem data para terminar.

  • O Desafio será revelado e as inscrições começarão no dia 14 de Março
  • As inscrições para participação estarão sempre abertas até o final do desafio
  • A submissão do projetos ocorrerá a partir de 14 de março e, atualmente, não há data para terminar.

6.2. Todas as datas claramente definidas nestas Regras e no Desafio estão no fuso horário de Lisboa (GMT) e referem-se ao ano 2020.


6.3. Quando necessário, devido a requisitos operacionais, o Organizador reserva-se o direito de alterar a duração do Desafio por um período de tempo razoável, que será transmitido aos Inovadores.


7. Princípio do desafio


7.1. O desafio consiste em fazer contribuições formadas por meios de entrega que estejam em conformidade com os requisitos identificados nos pontos 8 e 9.


7.2. O meio de entrega deve responder absolutamente à definição e às regras do Desafio, descritas neste documento. A entrega deve ser escrita em inglês para que possa contribuir para toda a gente no mundo inteiro; nenhum outro idioma será aceite. O organizador não vai aceitar nem rever nenhum outro documento enviado pelos inovadores.


8. Entregas


8.1. As Entregas do Projeto devem responder absolutamente à definição e às regras do Desafio descritas no separador "Regras" na página do Desafio.


8.2. A partir de 14 de março, os Inovadores terão que publicar na plataforma a sua Descrição de Projeto, composta por:

  • Questão COVID-19 abordada
  • Uma descrição que inclui uma breve explicação sobre qual é a solução e qual é o problema que enfrenta.
  • Capturas de ecrã ou imagens da Aplicação
  • Link do Código Fonte
  • "Technology stack" usada
  • Perfil do utilizador alvo (idade, sexo, profissão, etc.)

8.3. Além da Descrição do Projeto, os participantes devem anexar ao Projeto:

  • Apresentação de slides sobre o projeto
  • Capturas de ecrã, Imagem, Diagramas e Vídeos

8.4. Todos os anexos, vídeos e recursos com mais de 10 Mb podem ser carregados em sites externos como (Dropbox, Google Drive etc.) e fornecidos como links na descrição do projeto.


8.5. Os inovadores garantem que o conteúdo do projeto consiste apenas nas contribuições da sua equipa e de nenhuma outra. Se houver suspeitas que as contribuições sejam de terceiros, todos os Inovadores dessa equipa podem ser desqualificados.


9. Processo de seleção


9.1. O objetivo deste desafio não é encontrar vencedores ou selecionar as melhores soluções. É unir pessoas e aproximá-las para criar o maior número de soluções possíveis para prevenir e combater o COVID-19. Considerando isto, decidimos cancelar o processo de seleção por enquanto.


10. Direitos de autor de imagem


O uso de fotos ou imagens tem de estar livre de direitos de autor. Em qualquer caso, o Organizador não será responsabilizado pelo uso de Propriedade Intelectual sobre a qual terceiros podem ter direitos.


11. Prémios


11.1. Estamos a viver uma crise mundial e precisamos de agir rapidamente. Portanto, ter prémios de participação não é a nossa principal preocupação de momento, pois queremos acelerar o número de soluções para impedir a propagação do vírus.


11.2. No entanto, prometemos fazer o possível para encontrar uma maneira de recompensá-lo pelo seu trabalho e por ser capaz de dar um passo adiante como herói para as gerações presentes e futuras.


12. Propriedade intelectual


12.1. A definição de "direitos de propriedade intelectual" refere-se a qualquer invenção, direito de autor ou outros direitos sobre uma marca ou modelo e, de maneira mais generalizada, qualquer elemento que possa ser protegido por leis ou convenções internacionais sobre propriedade intelectual.


12.2. Qualquer projeto que envolva vários Inovadores constitui um trabalho colaborativo.


12.3. Como tal, o Organizador é livre para reproduzir os Projetos, distribui-los, informar o público sobre eles e modificá-los. Se os Projetos forem modificados, alterados ou adaptados, o Organizador poderá distribuir o trabalho derivado resultante, apenas de acordo com os termos acordados nestas Regras.


12.4. Cada Inovador garante que é o coproprietário e co-títular dos Direitos de Propriedade Intelectual, em relação à totalidade ou parte das entregas enviadas como parte do Desafio para o Projeto do qual é membro, e que obteve todos os direitos e permissões referentes a todos os elementos preexistentes, e quaisquer elementos para os quais não detenha os direitos, se esses elementos forem incluídos nas entregas de todas as fases da votação. Cada membro de uma equipa participante garante que a sua inscrição é original e sem precedentes, que não infringe direitos de autor de terceiros, e que todos os elementos da qual é formada, bem como todas as informações comunicadas no documento de apresentação de inscrição, são precisas, confiáveis e completas. É obrigatório que os Inovadores indiquem a fonte de quaisquer elementos preexistentes (música, texto, imagens etc.) incluídos nas entregas. Cada Inovador garante um bom uso das entregas/produtos fornecidos pelo Organizador e, como tal, garante:

  • que as entregas enviadas pela Equipa da qual é membro são originais,
  • que não viola nem imita nenhum direito de autor, patente, marca ou qualquer outra propriedade intelectual pertencente a terceiros,
  • que não constitui um ato de concorrência desleal ou parasitária de qualquer espécie,
  • que todos os elementos de que é formado, bem como todas as informações comunicadas nas entregas, são precisas, confiáveis e completas.
 Cada Inovador indemniza o Organizador e quaisquer subsidiárias presentes e futuras contra qualquer tentativa de perturbação, ação, reclamação, oposição, demanda ou despejo de terceiros.

12.5. Durante e após o término do Desafio, os Inovadores têm o direito de usar e registar a Propriedade Intelectual resultante dos Projetos criados (por exemplo código, algoritmos, etc.) para seu uso pessoal, desde que o código fique disponível para que todos o possam usar de forma gratuita, e visível na plataforma TAIKAI.


13. Comunicação


13.1. Todo o Inovador autoriza o Organizador, no caso em que seria nomeado uma Equipa Qualificada do Desafio, a usar o seu apelido, primeiro nome, endereço de twitter, cidade e região de residência, o nome da Universidade/Startup ou antiga Universidade e a fotografia, o nome em qualquer demonstração promocional (exceto com a compra de espaço publicitário), inclusive nos sites da TAIKAI e em qualquer site ou apoio afiliado, sem que esse uso possa legalmente dar origem a qualquer remuneração por, no máximo, 2 anos após o término do desafio.


14. Responsabilidade


14.1. A responsabilidade do Organizador não pode ser comprometida, em caso de falha ou disfunção da rede de telecomunicações usada, seja qual for a causa, o que teria o efeito de danificar ou impedir a identificação ou o acesso do Innovator ao taikai.network, ou a qualquer outro site, útil para a participação no Desafio.


14.2. A participação no Desafio implica conhecimento e aceitação das características, limitações e riscos da rede da Internet e das tecnologias a ela associadas, principalmente na consideração dos desempenhos, no tempo de resposta, na segurança do software e do hardware do computador em direção a diversos ataques em potencial, como vírus, bomba lógica ou cavalos de Tróia e perda ou desvio de dados. Pelo exposto, o Organizador não pode ser responsabilizado pelos danos causados ao Inovador devido a essas características, limitações e riscos aceites.


14.3. O Organizador não pode, em nenhum caso, ser responsabilizado por qualquer dano causado pela entrega defeituosa ou tardia dos Projetos, em particular pela recusa em aceitar entregas tardias, ou por qualquer dano causado pela impossibilidade de se conectar aos sites relevantes. sites ou fazer upload / download de qualquer entrega corretamente, pela entrega defeituosa ou tardia de qualquer email enviado durante o Desafio, ou por qualquer dano causado por qualquer obstáculo que impeça o Inovador de comparecer ou participar, de todo ou parte, no Desafio.


14.4. O Organizador não pode ser responsabilizado em caso de modificação total ou parcial, suspensão, interrupção, adiamento ou cancelamento de todo ou parte do Desafio por razões fora do seu controle. Nesse caso, o Organizador informará os Inovadores o mais rapidamente possível por meio da rede taikai.network ou por qualquer meio que considerar adequado.


14.5. O Organizador não pode ser responsabilizado pelas consequências da desqualificação de um Inovador e/ou de uma Equipa, devido a uma violação das Regras e/ ou no caso de rejeição de um Projeto devido ao descumprimento das Regras.


14.6. O Organizador não será responsável por qualquer problema, ação, reclamação, objeção, reclamação relacionada ao uso dos Projetos do Organizador não previstos pelas Regras ou em conexão com a negociação, execução ou desempenho de contratos que o Organizador assinaria com os inovadores.


14.7. Em qualquer caso, o Organizador não será responsabilizado pela entrega dos Prémios, nem em caso de impossibilidade de um Vencedor beneficiar do seu Prémio por circunstâncias fora do controlo do Organizador. A responsabilidade do Organizador não pode ser comprometida em caso de perda e / ou deterioração do Prémio pelo correio, ou por qualquer prestador de serviços terceiro similar e, de forma mais abrangente, se o Vencedor não receber o seu Prémio. A responsabilidade do Organizador não pode ser assumida em caso de incidentes ou danos de qualquer tipo, que possam surgir devido ao gozo do Prémio concedido e / ou devido ao seu uso.


15. Informação confidencial


15.1. “Informações Confidenciais” tais como definidas neste Regulamento, são todas as informações materiais ou imateriais de qualquer natureza, em particular administrativas, comerciais, científicas, técnicas, financeiras, fiscais, que foram ou serão comunicadas pelo Organizador ao Inovador, direta ou indiretamente, e de maneira não exaustiva, oralmente, por escrito, mediante entrega em papel ou por documentos eletrónicos. As informações que não são confidenciais são:

  • As informações atualmente acessíveis ou que se tornam acessíveis ao público sem violar as Regras do Inovador,
  • As informações legalmente mantidas pelo Inovador antes de serem divulgadas pelo Organizador,
  • As informações que não resultem, direta ou indiretamente, do uso de toda ou parte das Informações Confidenciais,
  • As informações obtidas validamente junto de terceiros, autorizados a transferir ou revelar as informações mencionadas acima.

15.2. No decorrer do Desafio, e no período de cinco (5) anos após o término do Desafio indicado na seção 6, o Inovador, sob pena de responsabilidade civil e / ou criminal, compromete-se a:

  • Não usar as Informações Confidenciais para outros fins que não a participação no Desafio nas condições do Regulamento;
  • Tomar todas as precauções necessárias, úteis e razoáveis para proteger as Informações Confidenciais;
  • Não revelar as Informações Confidenciais a ninguém, por qualquer meio, exceto aos outros membros da sua Equipa;

15.3. No final do Desafio, de acordo com os termos indicados no Ponto 6 ou ao cancelamento, o Inovador terá que devolver imediatamente ao Organizador todas as Informações Confidenciais, qualquer que seja o seu apoio, obtido durante o Challenge, sob penalidade de responsabilidade civil e/ou criminal. O Inovador proíbe-se de manter uma cópia de qualquer formulário, exceto com o acordo propositado, preliminar e por escrito do Organizador.


16. Regras


16.1. A participação no Desafio e a concessão do Prémio requerem a aceitação pura e simples e o total respeito pelas Regras em todos os seus termos. O Organizador reserva-se o direito de desqualificar, imediatamente e sem remuneração, todo Inovador e / ou Projeto que não atenda integralmente às Regras.


16.2. O Organizador reserva-se o direito de alterar, a qualquer momento, os termos das Regras durante o Desafio, sem necessidade notificar ao Inovador sobre a aplicação e a validade dessas modificações. O Inovador é convidado a consultar regularmente as Regras. O Inovador renuncia expressamente a qualquer reclamação ou contestação relacionada a qualquer modificação trazida ao Regulamento pelo Organizador.


17. Cancelamento e suspensão do desafio


17.1. O Organizador se reserva o direito de cancelar, reduzir, suspender o Desafio sem aviso prévio:

  • Em casos de força maior;
  • Se houver suspeita de fraude, sob qualquer forma:

17.2. O Organizador não pode ser responsabilizado pelo cancelamento ou suspensão do Desafio, de acordo com o presente Ponto, e não será devida nenhuma retribuição ou compensação ao Inovador.


18. Independência


18.1. O Registo e a participação no Desafio não são, de forma alguma, para criar um elo de subordinação entre o Organizador e o Inovador.


19. Reclamações


19.1. Qualquer reclamação do Inovador deve ser enviada por escrito do prazo de 30 dias após a data final do Desafio.


19.2. As reclamações relacionadas com o funcionamento do site taikai.network devem ser formuladas por escrito para seguinte endereço: TAIKAI, Lda. Building Connections, Av. Serpa Pinto 311, 4450-718 Matosinhos, Portugal


19.3. As reclamações relacionadas com o progresso do Desafio e com o envio do Prémio devem ser formuladas por escrito para o seguinte endereço: TAIKAI, Lda. Building Connections, Av. Serpa Pinto 311, 4450-718 Matosinhos, Portugal


19.4. Correndo o risco de ser rejeitada, qualquer reclamação deve conter: Detalhes completos do contacto do Inovador (apelido, nome, endereço, código postal, cidade, login no taikai e-mail); A identificação do desafio em questão; A apresentação clara e elaborada dos motivos da reclamação.


20. Reconciliação preliminar


20.1. No caso de uma disputa persistente após o Inovador apresentar uma queixa de acordo com o Ponto 19, o Organizador e Inovadores concordam em submeter a sua disputa a uma solução amigável antes de qualquer processo judicial.


20.2. A parte que deseja iniciar a conciliação deve informar a outra parte através de carta registada com aviso de receção, na qual o fará conhecer as suas intenções e especificará a causa.


20.3. Se não for celebrado nenhum acordo entre as partes no prazo de 30 dias após a receção da carta registada, as partes recuperam a sua liberdade de ação.


21. Lei aplicável


O Regulamento e o Desafio estão sujeitos à lei portuguesa. Aceita que qualquer litígio relacionado ao Desafio seja submetido exclusivamente aos Tribunais do Porto.
